物流责任综合保险条款

总 则
General Principles
第一条 本保险合同（以下简称为“本合同”）由投保单、保险单或其他保险凭证及所附条款，与本合同有关的投保文件、声明、批注、附贴批单及其他书面文件构成。凡涉及本合同的约定，均应采用书面形式。
Clause 1 This Insurance Contract (hereinafter referred to as “the Contract”) is composed of Insurance Application Form, Certificate of Insurance or other Insurance Certificates and the enclosed clauses as well as insurance application documents, declarations, comments, attached endorsements and other written documents that are related to the Contract. Any specifications that are involved with the Contract shall be made in writing.
第二条 凡在中华人民共和国境内（不含港澳台地区，下同）合法经营物流业务的企业，均可作为本合同的被保险人。
Clause 2 Any enterprises that are lawfully engaged in logistics business within the territory of the People’s Republic of China (excluding Hong Kong, Macao and Taiwan Regions, the same below) may be the Insurants of the Contract.
第三条 本条款中，物流是指被保险人及其雇员、代理人、其他独立经营人（如承运人、仓储保管人等）根据物流客户的需要，将货物从供给地向需求地转移的过程。它主要包括供应链管理以及运输、储存、流通加工、包装、装卸、搬移、配送、报关、报检、报验和信息处理等一系列活动。
Clause 3 In the clauses, logistics refers to the process in which the Insurant and his employee, agent or other independent operator (such as carrier and storekeeper) transfers goods from the supply location to the demand location in accordance with the requirements of the logistics customer. It mainly includes supply chain management and a series of activities such as transportation, storage, distribution processing, packaging, loading/unloading, and handling, distribution, customs declaration, application for quarantine inspection, application for examination and information processing.
第四条 本保险条款包括五部分：货损货差责任、额外费用责任、第三者责任、物流服务费用损失、通用条款。
Clause 4 The insurance clauses consist of 5 parts; Responsibilities for Damage and Shortage of Goods, Responsibilities for Additional Costs, Responsibilities of the Third Party, Losses of Logistics Service Charges and General Clauses.

第五条 在保险期间内，被保险人及其雇员、代理人、其他独立经营人在经营物流业务过程中，因下列原因造成货物的全部损失、部分损失或短量，依照中华人民共和国法律（不包括港澳台地区法律，下同）（以下简称为“依法”）应由被保险人承担责任时，保险人根据本合同的约定负责赔偿：
Clause 5 When the Insurant and his employee, agent or other independent operator undertakes logistics business within the period of insurance, in case the actual total loss, partial loss or shortage of goods due to the following reasons are the responsibilities of the Insurant in accordance with the Law of the People’s Republic of China (excluding the laws of Hong Kong, Macao and Taiwan Regions, the same below) (hereinafter referred to as “in accordance with the Law”), the Insurant shall be responsible for the indemnity as specified in the Contract.
1、火灾、爆炸；
Fire disaster, explosion;
2、偷窃、提货不着、抢劫；
Theft, non delivery, robbery;
3、运输工具发生碰撞、出轨、倾覆、坠落、搁浅、触礁、沉没，或道路、隧道、桥梁、码头坍塌；
Transportation facility meets with collision, derailing, overturning, falling, stranding, on the rocks, sinking or collapse of road, tunnel, bridge or dock.
4、货物遭受震动、碰撞、挤压、鼠咬、坠落、倾覆导致破碎、弯曲、凹瘪、折断、散落、开裂、渗漏、沾污、包装破裂或容器的损坏；
Goods are subjected to shock, collision, squeezing, mouse-bitten, falling or overturning which cause the goods to be broken, bent, dented, fractured, scattered, cracked, leaked, contaminated or the package fractured or the container damaged;
5、符合运输安全管理规定而遭受的水损；
Water damages that comply with transportation safety regulations;
6、错发、错运、错交导致货物无法追回或追回费用超过货物自身价值；
Goods that cannot be retrieved due to wrong delivery, wrong transportation or wrong handover or the expenses to retrieve the good exceed the value of the goods;
7、装箱、拆箱、拼箱、交付/接收货物、配载、积载、装卸、存储、搬移、包装或加固不当；
Improper encasing, uncasing, consolidating, handing-over/taking-over of goods, pre-stowage planning, stowage, loading/unloading, handling, packaging or securing;
8、交接货物时发现数量短少、残损；
Shortage of quantity or impairment is discovered in handover/takeover of goods;
9、冷藏机器设备原因导致货物腐烂变质；
Goods are decayed and deteriorated due to reasons of refrigerating equipment;
10、操作不当或使用的操作机械故障；
Improper operation or failure of the operating machine in use;
11、其他疏忽和过失行为。
Other negligence or faulty behaviors.
第六条 发生上述保险事故时，被保险人为防止或减少损失而支付的合理的施救和保护费用，以及事先经保险人书面同意支付的其他费用（以下简称“施救费用”），保险人负责赔偿。
Clause 6 The Insurer shall be responsible to compensate for the reasonable sue and labor expenses or protection fees paid by the Insurant in order to prevent or reduce the loss and other expenses that the Insurer agrees to pay in a prior written consent when the above insurance accident happens (hereinafter referred to as “sue and labor charges”).
第七条 被保险人因上述保险事故而被提起仲裁或者诉讼所支付的仲裁、诉讼费用，以及事先经保险人书面同意的律师费等其他必要的、合理的费用（以下简称“法律费用”），保险人负责赔偿。
Clause 7 The Insurer shall be responsible to compensate for the expenses paid by the Insurant for arbitration and lawsuit in case any arbitration or lawsuit is lodged by the Insurant for any of the above insurance accident as well as other necessary and reasonable expenses such as attorney fees that the Insurer agrees to pay in a prior written consent.
责任免除
Liability Exemption
第八条 由下列原因引起的货损货差，保险人不负责赔偿：
Clause 8 The Insurer shall not be responsible for any damage or shortage of goods caused by the following reasons:
1、货物设计错误、工艺不善、本质缺陷、自然渗漏、自然损耗、自然磨损、自燃或由于自身原因造成腐烂、变质、伤病、死亡等自身变化，但由于被保险人及其雇员、代理人、其他独立经营人的疏忽和过失不在此限；
Wrong design, imperfect workmanship, inherent defects, natural leakage, natural loss, natural wear, self combustion of the goods or their own changes such as decay, deterioration, wound/sickness and death, however, the above cases that are caused by negligence and fault of the Insurant and his employee, agent or other independent operator shall not apply.
2、被保险人自有的、租用的运输或装卸工具明显不适合运输或装载货物；
The transportation or loading/unloading facilities that are possessed or rented by the Insurant are obviously unsuitable for transportation or loading/unloading of goods;
3、被保险人自有的、租用的仓库明显不具备存储货物的条件；
The warehouse that is possessed or rented by the Insurant is obviously lack of conditions for storage of goods;
4、物流客户提供的货物数量、规格或内容不准确。
The quantity, specification or contents of the goods provided by the logistics customer are not accurate.
